Elvin Locken is an American of Norwegian ancestry. Elvin enters a skiing competition sponsored by the State of Oregon called the Oregon Winter Games. The officials deny Elvin entry into the events because he is of Norwegian ancestry. The official claims that Norwegians have an unfair advantage because of a strong history of snow sports, so have passed a rule banning Norwegians from the competition. How would a court resolve this issue?
A civil court would rule in favor of Mr. Locken. He would receive actual and punitive damages, because in the US, it is illegal to discriminate on the basis of nationality.
